SMS Opt-In Policy – SLAKPI LLC

1. Introduction

This policy establishes the procedures and requirements for SLAKPI’s Commercial Clients (law firms, real estate agents, businesses, etc.) to obtain consent from their End Users before sending them SMS messages containing relevant service information.

SLAKPI sends messages directly to End Users on behalf of its Commercial Clients and is responsible for storing and managing consent records.

2. Subscription Methods (Opt-In)

End Users may provide consent to receive SMS messages through the following methods:

2.1. Subscription via SMS

- The End User can subscribe by sending "YES" or "SÍ" to the number assigned to the Commercial Client.

- SLAKPI will register the user's consent and send a confirmation message with subscription details, the estimated number of messages per month, and how to unsubscribe.

Example confirmation message:

"Thank you for subscribing to [Commercial Client’s Name] messages. You will receive up to [X] messages per month. Reply STOP to unsubscribe. Privacy Policy - Terms and Conditions"

2.2. Subscription via Verbal Consent

- A representative of the Commercial Client may obtain verbal consent from the End User during a consultation or phone call.

- The Commercial Client must record the call or document the consent in a verifiable manner and report it to SLAKPI for registration.

- SLAKPI will store the consent in its database and use it to ensure that messages are only sent to authorized users.

2.3. Subscription via Form

- The End User may opt in by checking a consent box in an online or paper form.

- SLAKPI will register and store the form data as proof of consent.

Example form text:

"I authorize [Commercial Client’s Name] to send me up to [X] messages per month with relevant information. I can unsubscribe at any time by sending STOP. Privacy Policy - Terms and Conditions"

2.4. Automatic Consent via Initial Response

- If an End User sends a message requesting information without having previously subscribed, SLAKPI may send an automatic message requesting consent on behalf of the Commercial Client.

Example automatic message:

"Hello, we need your authorization to send you information. Reply YES to accept or STOP to unsubscribe."

- SLAKPI will register and store the user's response in its system to maintain a history of consents.

Example confirmation message:

"You have successfully subscribed to [Commercial Client’s Name] messages. You will receive up to [X] messages per month. Reply STOP to unsubscribe. Privacy Policy - Terms and Conditions"

3. Subscription Cancellation (Opt-Out)

- End Users can unsubscribe at any time by sending "STOP" to the same number from which they receive messages.

Example opt-out confirmation message:

"You have been unsubscribed from [Commercial Client’s Name] messages. You will no longer receive messages."

- SLAKPI will automatically process the opt-out request and update the database to ensure the user does not receive further messages.

- The Commercial Client must not attempt to send messages to users who have unsubscribed.

4. Responsibilities of SLAKPI and Its Commercial Clients

- SLAKPI stores and manages consent records of End Users.

- SLAKPI automatically processes subscription and opt-out requests.

- SLAKPI ensures that messages are only sent to users who have given their consent.

Responsibilities of Commercial Clients

- Obtain explicit consent from End Users before sending SMS messages.

- Report to SLAKPI any consent obtained outside the platform (verbal, forms, etc.) for registration.

- Ensure no messages are sent to users who have opted out.

5. SLAKPI as a Messaging Provider

SLAKPI acts as a messaging infrastructure provider but also manages consents by receiving and storing Opt-Ins.

- SLAKPI sends messages directly to End Users on behalf of its Commercial Clients.

- SLAKPI maintains records of consents to ensure regulatory compliance.

- Commercial Clients remain responsible for obtaining initial consent, but SLAKPI stores and verifies that consent within the system.
